San Francisco, CA: A defective products class action lawsuit has been filed against LG Electronics USA Inc. and Sears Holdings Corp. alleging the companies manufactured and sold defective washing machines.
The class action lawsuit, entitled Laury Smith v. LG Electronics USA Inc., et al., Case No. 4:13-cv-04361, in the U.S. District Court for the Northern District of California alleges the defendants misrepresented LG' top-loading washing machines as being "high efficiency", claiming the machines featured "extra high"spin speeds of 1,050 to 1,100 revolutions per minute. The lawsuit contends, however, that the machines tended to fall apart at high speeds.
The defective washing machines named in the class action are LG models WT5001CW, WT5101HV and WT5101HW; and Kenmore Elite brand models 29002, 29272 and 29278.
Lead plaintiff Smith filed the class action lawsuit following LG' December 2012 recall of some 457,000 washing machines. In the lawsuit, Smith states that in November 2011 she bought a Kenmore Elite Model No. 29272 for $579.99 plus sales tax at a Sears store in Hayward, California. The recall was issued only after the company received hundreds of reports of washing machines causing minor property damage, and one report of personal injury. Following the recall, the US Consumer Product Safety Commission (CPSC) indicated that the design defects posed a risk of personal injury and property damage.
Specifically, the lawsuit states: "The defective washing machines have the same inherent design defects that cause them to shake and vibrate excessively during use due to unbalanced loads that cause internal parts to come loose."
The defective washing machine class action lawsuit alleges unjust enrichment, breach of warranty, violation of the Magnuson-Moss Warranty Act, California' Consumer Legal Remedies Act, Unfair Competition Law, the Song-Beverly Consumer Warranty Act and California' False Advertising Law.

My LG 4.7 cu. ft. Ultra Large Capacity Top Load Washer Model # WT5170HV, also has rust all around the bleach dispenser and ruins all of my white clothes and linens. I have never had a problem with rust in a washer, ever.
Is there a class action lawsuit on this model, does anyone know?

Well I did not purchase a washer and from my experience with my LG refrigerator. What a piece of junk! First they make you wAit a week for an appointment just to diagnose then a months to get a compressor then of course more waiting for a tech to come back out to repair. All of this with a group of people that were coming in for a function at my home. Of course the company did not give a replacement knowing it would be a very long time but the first (of 3 techs) did say it usually takes about 3 months to get the parts. The 2nd tech soldered everything together guess what that meant? Yep still no working refrigerator. A 1.5 year old refrigerator and and this is what happens? Finally they sent a 3 rd tech who actually was very good. He finally got my refrigerator going but now I have a very high pitch coming from it. I am afraid to call because I can’t afford to go without a refrigerator for that long. I am saving up to buy another but different brand. I am just checking up to a horrible $3500 mistake. Stay away from the refrigerators as well!

I purchased a Kenmore Elite Refrigerator in Dec. 2015. When the first refrigerator was delivered, it had 5 big dents in the side of the refrigerator. The delivery guys returned it to Sears. My new refrigerator wasn't delivered until the end of January, 2016. within 11 months of the delivery, my Kenmore Elite stopped running two days before Christmas. After several service calls. I finally got a manager to order another refrigerator. This time the Kenmore Eliite ran less than a year, and the compressor went out. They replaced the compressor. In less than a week, that compressor went out. All these times the refrigerator went out, my food ruined. My Christmas meal was ruined when it went out the first time. Nothing was paid for food, because they were trying to say my refrigerator was out of warranty. It wasn't. I didn't get the second refrigerator until January 0f 2016. I was in total misery for two years with the refrigerator going out. They told me I needed to buy a new warranty, because the warranty was not covered, with the second refrigerator. They charged me $500.00 for a 3 year warranty. My compressor has now been in the refrigerator for over a year, but it is loud, and sounds like it is going out, all the time. Really noisy. I finally made LG pay for my hardwood floors, with the 3rd compressor. When the refrigerator quit, it poured water all over my floors. They did cover my floors, because I had only had my flooring a year. My daughter bought a LG Refrigerator, and it only lasted 3 years, they are shipping it to the trash tomorrow. I feel I was treated unfairly, because I kept having to replace food, especially two days before Christmas, and all the hardship it put on my family and I. I have more specific dates, and issues from this expensive Kenmore Elite that acts like a cheap bargain basement refrigerator. The plastic compartments have broken, the drawers have broken. It has been a horrific incident.

I have an LG WT5001C top load washer with rust all around the bleach dispenser. The unit is around 6 or 7 years old. Because it was out of warranty, I repaired it myself and fix the problem for a year, but now the problem is back and getting worse.

I have a Sears Kenmore Elite that was purchased late 2014. It has been serviced 5 times in 4 years. I have an advantage warranty, thank goodness. I have now been without the fridge working for almost a week and will not be fixed until Monday 5/7/18. The parts were 3 days late and I was told that I'd have a service date of 5/3/18 but then it changed to 5/7/18 because of their computer system error.
I can't even begin to express my disgust in Sears and this product! I'd gladly sue them and would like to see them have to pay or at least admit they're selling faulty merchandise and be held accountable!

I have the same issue. The rust is getting really bad around the bleach dispenser on my Wave Force True Balance topload washing machine. I called LG, sent them pictures and they gave me a run around numerous times and told me it wasn’t covered under warranty. Horrible customer service, horrible company and horrible appliance for the money. I purchased mine from Sears and will never buy LG or buy an appliance again from Sears. This should have been recalled and replaced for no charge by LG. I even asked them to just ship me the part and I’ll repair it myself. They refused and said it’s not their problem. Seriously a defect that should be replaced at no charge. There should be a class action lawsuit.

Here too is a 4 year old LG WT5001CW top load washer has rusting issues around bleach dispenser.
We should organize a class action legal law suit as this seems to be a major product defect just based on the number of on-line complaints posted.

Our LG Top Loader WT5070CW washer has rusted around the bleach tray & all the way around top rim. Big chunks of rusted paint falls into the drum where the clothes are and in between the wash drum and the washer shell. I have never had a washer RUST like this before... Also the washer doesn't clean your clothes very good... And the smell of mold is a huge problem. Please read reviews on this product. I know I will always check these sites for reviews on all products before we buy them!

I also purchased the LG top loader about 4 years ago. The bleach dispenser is so rusted out that the top is falling apart and also causing a loud noise when machine is spinning and washing. I paid $2000.00 for the set. This is so devastating. Please help! And I would like to know if I could get a refund or sign up for the class action suit????

we bought a lg model wt5101hv and had a rust problem in the lower left corner of our machine. After 4 months, back and forth phone run around they finally decided to replace the unit. They admitted to me that they had lots of complaints about this same problem before,and had corrected the problem. We've had the new unit for about 3 years and the very same problem is occurring.Then about 3 months ago I called about it,they told me there was nothing they could do about it then the unit began throwing itself off balance but,they told me there had been a soft ware recall on my model and they would come out and fix it.When the repairman came to the house he said they coded the work order wrong and to have them redo it.AFTER a few months had gone by,after repeated phone calls, the repair company(A&E appliance ) told me there was no recall on our model.Who should we believe?I thought lg was a
quality product, but after this I will never buy another lg product.

I too have a front loading washer. I can't get rid of the molded smell. I've tried Afresh, leave door open, bleach and vinegar!!! Nothing is helping!!! I hate this machine plus it is so loud and shimmies!

I have a LG Tromm Front loader WM0642HW which has been discontinued I have been noticing a very bad odor every time the washer is draining on the first wash! I bought this washer as a set in 2008 and now i am sick from the mold can i get some help i can't afford a new washer I paid $2200 for these big monsters and did not know about the harm they have been causing until i searched for a drain pump whioch had finally went out! Is it to late for me?

I have an LG True Balance Model# WT5101HV washing machine that I am having an issue with the top rusting on it. Looking at reviews there has been many issues from other people having this same problem with rust. Has there been anything regarding this problem brought to the attention of this lawsuit. LG support claims that it is a cosmetic issue and there is nothing they are willing to do about it, the part has even been discontinued so now I have to sit and watch my 5 yeah old washing machine that I paid well over $700 for rust away. Is there anything being done or that can be done? Thanks

I am going through the same issues with my LG top load washer. My serial number is on that recall list. I have already paid $96.79 for a sears home repair service technician to tell me the noise was because the motor needs to be replaced,.. After collecting my money he advised me to call LG to have this repaired under the 10 year motor warranty. I did just that. An LG supervisor made an appointment for an A&E technician to come out to fix the problem. The technician called me the day of the service date to tell me he was on his way, but NEVER showed up. FYI SEARS HOME REPAIR COMPANY & A&E repair company are sister companies, but LG only recognizes A&E as an approved service provider for their applainces.) after numerous several hours on the phone with LG, SEARS, and A&E,.. My machine has not been fixed. They also want to charge me a few hundred dollars for labor & repair costs. I would greatly appreciate any advice.
